Hopefully its bullshit but it could be that a beta tester leaked the distro for financial gain

It's fake.
Just look at the info they give.
2006-02-05 Development Release: BackTrack 3.0 Beta
The first public release of BackTrack, a SLAX-based live CD with a collection of security and penetration testing tools, is now available: "Yes, it’s out there and its wild. Remote-Exploit would like to introduce BackTrack - the consolidation of the two leading penetration testing live CD distributions - WHAX and Auditor. The new distro features the best of both distributions, and lots of nifty features, including the latest tools and exploits, an appealing interface, accessibility, and rich Python development environment." Visit the project’s news page to find out more about the release. Download: backtrack-beta-05022006.iso (625MB, MD5).
BTW: the first beta of version 3 was only 280MB as it is only the core plus a few wireless components.

It's probably BT 2 beta 3. Trying to give them the benefit of the doubt.

I've seen BT on eBay and other sites, I just think it's funny that some ppl are stupid enough to pay $39 etc for a Burned CD.
IMHO it sucks that Mutt et al aren't getting the $. But, buyer beware, if you're to dumb not to do a simple google search on some obvious strings from the ad/post then you deserve to have your money taken.
